§1 Scope of application: Costs and performance

which are hereinafter collectively referred to and represented as the "Organizers".

3. participation in the raffles organized by the organizer is generally free of charge.
4. the organizer will raffle off one or more prize(s) specifically
mentioned in the respective competition among all participants.
5. the participant's consent to being contacted for advertising purposes by the
organizer as well as conditions specifically stated in the respective competition
(e.g. liking a post, following a profile, etc.) may be a prerequisite or consideration. As a rule, the address will not be passed on to
external third parties, with the exception of partners in the course of delivering the prize.
§2 Eligibility to participate
- Eligible to participate are persons who have reached the age of 14 and are resident in Germany, unless otherwise stated. Persons may only participate once per platform on which the respective competition is played out. Violations will lead to exclusion from participation or, in the event of a win, to forfeiture of the right to win.
- The organizer reserves the right to exclude persons from participation as soon as a suspicion of manipulation arises.
§3 Rights of third parties
- If participants are required to provide their own work in order to take part in the competition (e.g. texts, drawings, photographs, etc.), they declare that their work for the competition does not infringe the rights of third parties, in particular copyrights and personal rights. Violations will result in exclusion from participation or, in the event of a win, loss of entitlement to the prize.
- If other persons were involved in the creation/development of the entry, they must agree to its submission and subsequent publication as part of the competition. The same applies if third parties have been granted exclusive rights to the submitted entries. Even if persons are recognizable on submitted services/materials, their consent to the submission and subsequent publication must be obtained.
§4 Settlement
- Payment of the prize in cash or in kind, its exchange or transfer to other persons is excluded. A winner may relinquish their prize. In this case, the next person will take his/her place or another winner will be chosen under the existing conditions. The prize will generally be delivered by post to the address provided by the winner.
- Notification of the prize will be sent in the same way as participation in the competition, e.g. via social media channels (Facebook, Instagram, etc.) or in the case of e-mail participation (e.g. via a newsletter) by means of an e-mail notification. The participant is obliged to cooperate in the processing of the prize by responding to the notification, e.g. by sending the address for sending the prize. If the winner does not comply with this obligation within 14 days, the prize is forfeited and the organizer is entitled to deal with the prize in another way.
- In the event of unsuccessful delivery of the prize, the organizer reserves the right to determine a new winner or to deal with the prize in another way. If the contact details provided are incorrect (e.g. postal or e-mail addresses), the organizer is not obliged to determine correct addresses. Any disadvantages resulting from the provision of incorrect contact details shall be borne by the participant.
§5 Data protection information on the competition
- The data collected as part of the competition will be stored by the organizer in accordance with the statutory retention period; if personal data is not subject to a retention period, it will be deleted no later than three months after collection. The organizer's right to continue to store and use the data as part of an existing contractual relationship remains unaffected by this.

- The participant agrees that his/her submissions to the competition and the personal data submitted (first name, surname, profile name, location, photograph or other electronic materials) may be published in connection with the competition, its draw and processing on the media/platforms on which the competition took place.
§6 Liability
- The organizer shall only be liable - irrespective of the legal grounds - if damage is caused by culpable breach of a material contractual obligation (cardinal obligation) in a manner that jeopardizes the achievement of the purpose of the contract or is attributable to intent or gross negligence. If the organizer is liable in accordance with the above paragraph for the breach of an essential contractual obligation without intent or gross negligence, the liability is limited to the extent that the organizer could typically expect at the time of conclusion of the contract based on the facts known to them at that time.
- The above limitations or exclusions of liability shall not apply in the event of culpable injury to life, limb or health, for liability claims under the Product Liability Act or in the event of a contractually agreed no-fault obligation to assume liability or if the relevant circumstance giving rise to liability was fraudulently concealed.
- Insofar as the liability of the organizer is excluded or limited in accordance with the provisions of this exclusion of liability, this also applies to the personal liability of executive bodies, employees, representatives and vicarious agents.
§7 Changes to the rules of participation and termination of the competition
- The organizer reserves the right to change the conditions of participation at any time.
- Furthermore, the organizer reserves the right to terminate or interrupt the competition or prize draw at any time for good cause without prior notice. This applies in particular to reasons that would disrupt or prevent the competition or prize draw from proceeding as planned. If such a termination is caused by the behavior of a participant, the organizer is entitled to demand compensation from this person for the damages incurred.
§8 Individual conditions of the respective competition
- Individual conditions (e.g. duration of the competition, type and scope of the prize) are specified in the respective competition. There may be deviations from these competition terms and conditions that only apply to the respective competition. They then take precedence over these terms and conditions.
- Should individual provisions of the conditions of participation be or become invalid, the validity of the remaining conditions of participation shall remain unaffected. They shall be replaced by an appropriate provision that comes closest to the purpose of the invalid provision.
To improve readability and simplify understanding, the generic masculine is used in the explanation of the conditions of participation. Unless otherwise indicated, the personal designations used in this text refer to all genders.
